How Debt Review Removal Works

Quick answer: Debt review is removed in one of three legal ways: a Form 19 clearance certificate once your restructured debts are paid up, a court order if your finances have recovered before full repayment, or a bureau dispute if you were never lawfully placed under debt review. Anyone promising removal outside these routes is selling something that does not exist.

We check which route you qualify for at no charge, tell you honestly if removal is not yet possible, and handle the paperwork when it is. The National Credit Regulator has warned repeatedly about β€œguaranteed removal” operators β€” the safe path starts with knowing your legal status, not with paying an upfront fee.

The 3 Removal Routes Compared

RouteWhen it appliesTypical costTimeline
Clearance certificate (Form 19)All restructured debts are paid up β€” your home loan may remain if it is up to dateR0 β€” included in the aftercare fees you already pay your counsellor7–21 business days after your paid-up letters are in
Court rescission (Form 17W)Your income has recovered and you can afford your original payments before the debts are paid upR5,000–R15,000 in attorney and court costs, and the outcome is not guaranteed2–4 months, depending on the court roll
Bureau dispute via the NCRYou were never lawfully placed under debt review β€” no Form 17.2 acceptance and no court order existsR0 β€” disputes at the credit bureaus are free20 business days for the bureau to resolve the dispute

If a removal company quotes you a fee without first asking which of these three situations you are in, walk away. The route decides the cost, not the other way around.

Frequently Asked Questions

Can debt review be removed from my name?

Yes, but only through a legal route. If your debts are paid up (or only your home loan remains and it is up to date), your debt counsellor issues a Form 19 clearance certificate and the flag is removed from the credit bureaus. If your debts are not paid up but your finances have recovered, a court order declaring you no longer over-indebted is required. There is no legal shortcut that deletes the flag while you still owe restructured debt.

How much does debt review removal cost?

If you qualify for a clearance certificate, the process is often included in the fees you have already paid under the NCR fee structure β€” ask your debt counsellor before paying anyone new. Court-based removal involves attorney and court costs, typically R5,000 to R15,000 depending on complexity and whether creditors oppose. Be cautious of anyone quoting a flat fee for 'guaranteed removal' without first checking which route you legally qualify for.

How long does debt review removal take?

Clearance certificate route: usually 7 to 21 business days once all paid-up letters are in, and the bureaus must update your profile within about 7 business days of receiving the Form 19. Court route: typically 6 to 12 weeks depending on court availability in your area.

Can debt review be removed without a court order?

Only in two situations: you completed the process and qualify for a clearance certificate, or you were never legally placed under debt review (no Form 17.2 acceptance and no court order) and the listing can be disputed with the bureaus and the NCR. If a rearrangement order exists and you still owe restructured debt, a court application is the only lawful exit.
